I.- PURPOSE AND SCOPE OF APPLICATION

The purpose of these provisions is to regulate the use of the electronic sales services for various goods and services offered by CWB SPAIN SL, hereinafter referred to as EPIXLIFE, a commercial company that operates online through its website www.epixlife.com, selling products and services to its customers for well-being optimization.

The clauses outlined below constitute the framework contract that all users accessing the website www.epixlife.com are obligated to know and accept. For the purposes of these general conditions, the term “user” includes any internet user who accesses the website www.epixlife.com, either directly or from any other internet site.

The services offered by EPIXLIFE on this website shall be governed by the conditions set forth in this contract. EPIXLIFE reserves the right to modify, in whole or in part, these general conditions, with the new conditions becoming applicable from the moment of their publication on the website. In any case, these modifications shall not have retroactive effects on goods or services already previously contracted by users.

These General Conditions bind both parties and form an integral and inseparable part of the sales contract, the effectiveness of which occurs upon the customer’s order placement through the specified contracting mechanisms, all in accordance with the provisions of Article 1,255 of the Civil Code, which encompasses the principle of freedom of will and agreements between the contracting parties. For all purposes, it shall be understood that, by placing an order, the user accepts the conditions and rules of use stated herein.

To ensure the integrity of the rights of consumers and users of EPIXLIFE, these General Conditions are established in accordance with Spanish law, particularly Law 3/2014, of March 27, which amends the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, Law 7/98 of April 13 on General Conditions of Contracting, Law 7/96 of January 15 on Retail Trade Organization, Civil Code, Directive 2000/31/EC of the European Parliament and of the Council of June 8, Law 34/2002 of July 11 on information society services and electronic commerce.

II.- IDENTIFICATION AND LEGAL NAME OF THE OFFERING COMPANY

CWB SPAIN SL, with registered address at Calle de la Travesía s/n, Base 2- Marina Real de Valencia 46024, and Tax ID B98819477, provides its electronic sales services via the website www.epixlife.com. The contact email is hola@epixlife.com. The address for claims corresponds to the registered address of the company.

III.- OBJECT

These General Conditions regulate the contracting of products and services for well-being optimization by EPIXLIFE and the advertising directed at its customers/users, all through its website, as well as the rights and obligations of the parties arising from the sales transactions concluded between them.

IV.- LEGAL CONDITIONS FOR SERVICE PROVISION AND RESPONSIBILITY, CLARITY, AND TRANSPARENCY IN INFORMATION

In compliance with Article 10 of Law 34/2002 of July 11, EPIXLIFE, through its website and these General Conditions, enables permanent, easy, direct, and free electronic access to comprehensive information regarding its business name (tax, registration, address, and communication address), as well as to the customer’s data, accessible exclusively to the customer, held by the company.

V.- ACCESS CONDITIONS FOR THE USER/CUSTOMER

The user of the EPIXLIFE website is entitled to free and unrestricted access to public information available on the website. However, EPIXLIFE reserves the right to restrict access to information, promotions, and special offers to its registered customers.

Any user accessing the EPIXLIFE website has the right to register as a customer, thus being able to avail special offers intended for registered customers, provided they meet the specific conditions for each product.

The public information contained on the EPIXLIFE website, both regarding the company EPIXLIFE and the brands, products, logos, etc., of the wholesale companies and manufacturers of the offered products and services, is protected by the legal provisions on intellectual and industrial property. Therefore, copying, transmission, assignment, sale, or use of such information by the customer for purposes other than advertising and without the express consent of EPIXLIFE or the product manufacturer or trademark holder, as specified in section XI on Industrial and Intellectual Property Rights, is not authorized.

USER REGISTRATION

The customer/user, prior to formalizing the purchase of any products offered by EPIXLIFE, must provide their personal data and details necessary for the formalization of the sales contract (name and surname or legal name, ID/NIF, address, email address, phone/fax number).

To place orders on the website, each customer shall voluntarily and under their own responsibility provide their personal data to EPIXLIFE.

All personal data fraudulently or falsely provided by customers may be considered as a crime of falsification of commercial documents.

EPIXLIFE offers the customer a personal registration system through a personalized access key (login) and a password for facilitating future purchasing operations. In this case, the customer may choose their desired key and password, provided they are available or not assigned to other customers. Through an automated process, if desired by the customer, EPIXLIFE will generate the access key and password for the customer. Keys or passwords containing immoral, defamatory, demeaning, discriminatory, or unlawful content, or those referring to trademarks, products, or protected names as per the legal provisions on Intellectual and Industrial Property, or contrary to the rights to privacy, honor, and self-image, will not be accepted.

The customer commits to ensuring the confidentiality of their access key and password. EPIXLIFE is exempt from any liability arising from the customer’s incorrect use or negligence in complying with their obligation to maintain the confidentiality of their access keys.

VI.- OFFER AND ACCEPTANCE PROCESS.

TERMS OF SALE AND PRODUCT DELIVERY

Price policy: EPIXLIFE reserves the right to unilaterally modify the price of products and services offered through its website at any time. To ensure the customer’s certainty and security regarding the price of their products, the price at the time of formalizing the order shall be the one shown in the advertising coinciding with the moment of order placement.

The following steps will be followed in the electronic purchasing process according to the menu options on the EPIXLIFE website:

Information about the product offered to the customer Well-being Optimization Report Optimization Report for Athletes and Elite Athletes Optimization Report for Vegans: description, manufacturer’s brand, indicative photograph (if applicable).

The purchased product may undergo non-substantial modifications in components, characteristics, or features due to manufacturer availability, provided such modifications do not detract from the advertised qualities and features.

Information about the product price: information about the final price or retail price of the product to be acquired, including the final cost for the customer, including VAT, shipping costs, and merchandise insurance and handling resulting from transportation. The final cost will be communicated to the customer in the electronic purchase process before they formalize their acceptance by selecting the “order acceptance” option from the menu. Possible discounts or promotional gifts will be freely directed by EPIXLIFE to specific groups designated by EPIXLIFE at any given time or based on the offered product, according to the existing advertisements on their website.

Order acceptance: At the moment of formalizing the order, once the order acceptance option from the menu has been used, the customer’s consent to the validity and effectiveness of the sales contract binding the parties is presumed. EPIXLIFE will electronically store the order.

EPIXLIFE’s commitment to sell and deliver the advertised merchandise is subject to the stock of the announced product and its availability until exhaustion. Therefore, in EPIXLIFE’s commitment to quality and customer service, efforts are made to ensure that the advertised products are always available. However, in the event of exceptional circumstances of interactive multi-ordering or other circumstances leading to the exhaustion of the product, the order and contract entered into between the parties shall become null and void under this resolutive clause, fully refunding the customer for any amounts paid in case of prepayment, with no compensation to either party for breach of contract, consequential damages, or lost profits.

Customer payment methods: The following payment systems are established: Google Pay, Paypal, Shopify Payments, Payment Gateway – Visa / Mastercard Card, Shop Pay, Amazon Pay, Pay + Afternoon, Postpone, Cofidis, FinOnline, Klarna, Latter Pay, Oney, Sequra.

Invoice: EPIXLIFE will issue an electronic invoice (PDF) and send it by email after the sale has been made. EPIXLIFE advises that invoices for sales cannot be modified later in compliance with current regulations (Royal Decree 1496/2003 on invoicing, amended by Royal Decree 87/2005). The invoice will be issued in the name of the individual or company placing the order, so the customer must ensure that the order is placed in the correct name. Subsequent changes are not possible.

Delivery time for the purchased product: An effective delivery period of 48 to 72 hours is set for the product, starting from the moment the delivery date was determined when formalizing the order, and once the payment for the product has been validated through the assigned platforms.

Place and form of delivery: The order will be delivered to the domicile designated at the time of contracting by the customer. Any subsequent change in the requested delivery location by the customer may incur additional expenses on top of the sale price, which will be borne by the buyer. The merchandise will be delivered to the customer by the United Parcel Service España Ltd and Compañía S.R.C transport company, also known as UPS, along with a delivery note stating the details that identify the customer, the order, and the number of packages comprising the shipment. The merchandise is at all times covered against transport risks, loss, and manipulation.

In the event that the customer verifies errors in the received merchandise at the time of delivery or that it is visibly damaged, they must record these circumstances in the carrier’s delivery note and notify EPIXLIFE of these facts within 24-48 hours in writing or via email to hola@epixlife.com, using the customer service provided on their website and completing the withdrawal form provided for this purpose, directed to the email or the company’s registered address. In any case, the customer must ensure that the merchandise has been delivered in perfect condition.

Claims made after 14 business days after delivery will not be accepted.

The merchandise delivered to the customer must be used within an agreed period of 72 hours and returned to the company for analysis. If the “kit” is not received within this period, EPIXLIFE will not accept returns for products manipulated by the customer or for merchandise returned incomplete in both its main and accessory elements.

Merchandise that cannot be delivered within 48 hours or 2 business days from leaving EPIXLIFE’s premises for reasons not attributable to the seller will be returned, with full refunds for prepaid orders.

VII.- PRODUCT WARRANTY

The warranty for products sold by EPIXLIFE is provided and established in accordance with the existing legislation on warranties in the Sale of Consumer Goods, a legal framework that aims to provide consumers with various options to demand rectification when the purchased good does not conform to the contract. The consumer is given the option to demand repair or replacement of the good, unless this is impossible or disproportionate. When repair or replacement is not possible or disproportionate, the consumer may demand a price reduction or contract termination.

Commercial warranty: Manufacturers may offer additional warranties, varying in extent and duration depending on the products and brands. These warranties are the sole responsibility of the manufacturer offering them. In accordance with this law, the seller is obliged to deliver to the consumer a good that conforms to the sales contract in the terms established by the law itself. Therefore, as stated in Article 4 of the aforementioned law on the seller’s liability and the buyer’s rights: “The seller will be liable to the consumer for any lack of conformity existing at the time of delivery of the good. According to this law, the consumer is entitled to repair of the good, its replacement, price reduction, and contract termination.” In any case, the product lot number to be repaired must match the files owned by EPIXLIFE.

EPIXLIFE shall not be responsible for possible damages resulting from misuse or mishandling. The warranty shall not be valid in cases of factors external to the normal use of the product by the customer or by third parties not authorized by the manufacturers. VIII.- CUSTOMER RIGHTS

Confidentiality and security of the customer’s personal data in accordance with the current Spanish legislation on data protection. No dissemination, transmission, or publication of customer data without their express consent. No receipt of promotional or advertising emails if rejected. Access to, modify, and delete the customer’s personal data held in the EPIXLIFE database at the customer’s request, all in accordance with the provisions in the section on Personal Data Protection.

Free access to the open sections of the EPIXLIFE website at any time. Being informed about the current status of the placed order at all times.

Withdrawal/unilateral revocation of the requested order: In accordance with the provisions of Article 104 of Royal Legislative Decree 1/2007, approving the consolidated text of the General Law for the Defense of Consumers and Users, the customer (consumers or users are solely individuals or legal entities that acquire, use, or enjoy the product as end users) has the right to revoke the requested order within a period of fourteen days from its receipt. This must be communicated to EPIXLIFE within that period for the appropriate return procedures to be established (return number, and form and address for the return shipment), with a refund of the amount paid only for the product. In case of exercising this right of withdrawal, the return costs and any damages suffered by the product or merchandise shall be borne by the customer. Returns will not be accepted for used products, broken seals, or opened containers. Return costs will be deducted from the product price at the time of the money refund. In no case can returns or merchandise exchanges be managed at our registered address.

EPIXLIFE shall not accept returns for products manipulated by the customer or for merchandise returned incomplete in both its main and accessory elements. The right of withdrawal shall not apply to products that, due to their nature, cannot be returned. The right of withdrawal shall also not apply to goods or orders that may be considered, due to their special characteristics, as tailored to the customer’s request.

Professionals: Those who, without being end users, acquire, store, use, or consume goods or services for the purpose of integrating them into processes of production, transformation, commercialization, or provision to third parties shall not be considered consumers and users. Therefore, they are not entitled to the rights granted to consumers.

Instructions for product shipping: The return shipment will not be managed directly at our premises but will be handed over to the carrier for shipping. We inform you that, to avoid any incidents, it is necessary for smaller products to be protected by external packaging—just as you received it at your home—to avoid any damage or manipulation of the original product packaging during transport. For larger products, external protection of the original packaging is not essential. However, it is important to ensure that the product is properly protected inside the original box with the protections provided for this purpose (corks, polystyrene, bubble wrap, etc.) and avoiding any manipulation of it. IX.- OBLIGATIONS OF THE USER/CUSTOMER

  • Safeguard personal passwords with due diligence. – Use the information published by EPIXLIFE exclusively for the customer within the intended personal commercial relationship. – Do not reproduce, alienate, or dispose of the information published by EPIXLIFE in all its contents without the express permission of the company itself. – Faithfully use the shopping service provided by EPIXLIFE on its website, refraining from manipulating its website content or interfering with its computer systems through viruses or other behaviors prohibited by law. – Honor the purchase agreement once the order is accepted, with the appropriate payment of the agreed price.

X.- RIGHTS OF EPIXLIFE

  • Preserve, modify, or suspend its website without prior notice. – Modify the prices of offers. – Reject orders due to lack of stock or non-payment by the customer. – Deny access to computer tools to customers in case of breach of these conditions. – Collect the amount of customer purchases once the transaction is accepted. – Reserve the domain and retain full ownership of the item until full payment by the customer. – Reserve the right to conduct draws for goods or services on its website.
